-------------------------------------------------------------------- TAG HELL-BENT ON SELLING CLIENT HOUSE -------------------------------------------------------------------- Mum has dementia and has been in a nursing home since late 2015. TAG (NSW Trustee & Guardian) took over about a year later due to sibling conflict (a story in itself). I (aka DZJ) was Mum's carer and had lived with her for 5 years in her house which has been the family house since my birth. About a year ago TAG wanted to sell Mum's house even though it would mean she would lose $70k per year (by their own figures) for the first 2.5 years and $50k per year thereafter. That is as opposed to me renting out rooms to cover nursing home fees. It made zero financial sense to sell. TAG tried to bully me into not renting out in the meantime. For a year I complied (depriving my Mum of a year's rent) but I then discovered the exact clause in the law which allowed me to ignore their directions so I established stable and sufficient rental income with lodgers before the hearing. I won the NCAT hearing opposing the sale but the attempted financial abuse was downplayed in order to let TAG save face. The arithmetic showing the abuse was acknowledged but not condemned and was not given as the reason for the decision going my way. The main point NCAT honoured in my favor was that TAG totally ignored UN Charter on Rights for the disabled s39(e) - "preserving the family.relationships" (which is still pretty damning because half my submission was about that but TAG refused to even comment on it). This charter supports that I be allowed to continue living in the house (and therefore that the house not be sold) because I could then continue my visits to Mum in the nursing home. My visits have been daily ever since nursing home neglect almost killed her (at about the same time as TAG took over, as it happens). More on this in a separate section below. Since then, however, TAG have refused to keep Centrelink updated, resulting in pension cancellation. This sabotage of her finances means her funds have been depleted enough (they think) that they now can have another go at selling the house to continue paying nursing home and TAG fees (although by their own admission she has enough funds for 2.5 years of fees and that is without even reinstating her pension). I am not allowed to contact Centrelink on her behalf but have submitted a fraud report (a federal crime).
