Case of XXXXX (aka DZJ)

Son of YYYYY - Centrelink client number XXXXX

Centrelink Have not Notified MyAgedCare?

Centrelink are aware that YYYYY has annual rental income of at least $32,600 which puts her above the annual income threshold of $29,234.40. If her income is above this amount she needs to pay a Daily Accommodation Contribution (DAC) for her aged care facility (ACF). $12.38 DAC in fact. And yet YYYYY pays no DAC. One would think this is an error in her favour but no: it erroneously disqualifies her from an Age Pension.

YYYYY is better off receiving a pension and contributing to her ACF accomodation costs than to have no pension and have free accomodation. It is the difference between keeping her house and selling it and ultimately a matter of life and death for YYYYY, it is that serious.

It is Centrelink's responsibilty to notify MyAgedCare who then calculate the DAC yet it appears they either have not notified them or the calculation has not been performed.

What makes this even more outrageous is that a transcript of a conversation with Centrelink reveals that the Public Trustee would have had to request "hardship provisions" from Centrelink to be able to sabotage the financial standing of YYYYY as described above. This can just as easily be remedied by them asking Centrelink to withdraw those hardship provisions.

On 20 July 2022 I went to Marrickville Centrelink to show them the Tribunal's acknowledgement of the rental income (a printout of information which is available publicly on the caselaw web site) and yet the manager, XXXXX, refused to accept the document from me or formally record that I have notified her of the anomally because she says only the Public Trustee can act for my mother.

I pointed out that it is potentially welfare fraud but she merely gave me the phone number for their fraud report line. Calling that number is pointless because I filled out their online form a year ago about something similar but they never responded.

I then went to nearby Anthony Albanese's office who refused to deal with the matter because they apparently do not deal with "legal issues".
